Assalaamu`Alaykum wa Rahmatullaahi wa Barakaatuhu
Dear Owners and Moderators of Islamic Groups,
I pray you are all well and in strength of eemaan by the grace of Allaah Subhaanahu wa Ta`aala.
You may recollect that I wrote to all of you on September 03, 2007 vis-à-vis the plagiarism and copyright infringement of brother Shahid Khan on several articles he had posted.
<<< Please put brother Shahid on moderated status and check his articles before transmitting them to your members, inshaa`Allaah. You can put a stop to this sort of "literary theft" reaching our unsuspecting Ummah. You can protect our brothers and sisters in Islam from unknowingly forwarding haraam/plagiarised material and be duly held accountable to Allaah Subhaanahu wa Ta`aala? You can make a difference. Please do. Protect yourselves from association to "literary theft", inshaa`Allaah. >>>
Despite my communiqué to you on September 03, 2007 (attached below my message to Shahid Khan) for the sake of Allaah Subhaanahu wa Ta`aala's Deen, it was ignored allowing his "literary theft" to continue and continue, this time on Shaykh`Umar Sulayman Al-Ashqar's writings on "Paradise and Hellfire" as evidenced by today's (April 06, 2008) posting of "The Disbelievers Among the Jinn Will Be In Hell" - a period of seven (7) months of infringement!
Shahid Khan tried to absolve himself by this statement (to our unsuspecting Muslims) placed at the end of his plagiarised postings:
Compiled from various sources.
Permission is granted to circulate among private individuals and groups, to post
on Internet sites and to publish in full text and subject title in not-for-profit publications.
His claims are dishonest because it is not from various sources, - it was only from one source per verbatim, namely that of Shaykh`Umar Sulayman Al-Ashqar's. And the "permission" Shahid Khan "granted" is perposturous and misleading as no rights had been granted to him by the author to post his writings without due mention of his name. It is also a copyright infringement (i.e. copyright violation) - by using unauthorised material in the manner that violates the owners's exclusive rights, here again, by deleting the owner's name.

Dear moderators and owners, will you still continue to post Shahid Khan's "literary theft"?
You can't imagine the unenviable task and toll it has taken on me to write the above. But it had to be done, for the sake of Allaah Subhaanahu wa Ta`aala's Deen.

Dear Brother Shahid,
I pray you are well and in strength of eemaan by the grace of Allaah Subhaanahu wa Ta`aala.
Inshaa`Allaah you have read my communiqué of the 1st instant vis-à-vis the subject on plagiarism.
I hoped the information on plagiarism would have given you food for thought. Apparently not from the three (3) articles you posted after receipt of my email. Wa a`oodhu billaahi minhum!

I have provided enough in my first communiqué to show you the error of what you have done. The haqq is clear, and the Prophet sall Allaahu`alayhi wa sallam has told us that he sall Allaahu`alayhi wa sallam has left us Muslims upon "a clear path, its night is like its day. No one deviates from it except that he is destroyed." So I pray that Allaah Subhaanahu wa Ta`aala guides you back to this Path, and that He Subhaanahu wa Ta`aala opens your heart to the haqq. And know that rejection of the Truth is nothing but arrogance. Regarding this, our Prophet sall Allaahu`alayhi wa sallam said, "he who has in his heart the weight of a mustard seed of arrogance, shall not enter Jannah (Heaven)." A man said, "one loves his dress to be nice, and his sandals be nice." He sall Allaahu`alayhi wa sallam said, "verily, Allaah is Beautiful and He Loves beauty. Arrogance is rejecting the truth and disregarding the people." [Saheeh Muslim].
Narrated Aboo Hurayrah radhiallaahu`anhu: The Prophet sall Allaahu`alayhi wa sallam said, "The worst people before Allaah on the Day of Resurrection will be the double-faced people who appear to some people with one face and to other people with another face." Narrated Aboo Hurayra radhiallaahu`anhu: Allaah's Apostle sall Allaahu`alayhi wa sallam said: "The worst of all mankind is the double-faced one, who comes to some people with one countenance and to others, with another countenance." Dear Owners and Moderators of Islamic Groups,
I pray you are all well and in strength of eemaan by the grace of Allaah Subhaanahu wa Ta`aala.
As you are aware, I wrote to brother Shahid Khan on August 01, 2007 vis-à-vis his plagiarism.
I provided the daleel to the brother and your goodselves by Shaykh Bakr ibn 'Abd-Allaah Abu Zayd and Imaam Muhammad bin Saalih Al-`Uthaymeen rahimahullaah, respectively:
Shaykh Bakr ibn 'Abd-Allaah Abu Zayd said: "These clauses which protect works from tampering or interference, and protect the value of the work and the efforts of its authour, are things that are regarded as essential, based on the general principles of Islam. This is indicated clearly in the texts and basic principles of sharee`ah, which you can find explained in detail in Adaab al-Mu'allifeen and Kutub al-Istilaah. (Fiqh al-Nawaazil, 2/65) http://www.islam-qa.com/index.php?ref=26307&ln=eng
Imaam Muhammad bin Saalih Al-`Uthaymeen rahimahullaah has ruled that whatever is customary among people should be the rule except when a user wants a copy for himself and the authour or the copyright holder has explicitly stated certain conditions, then it is not permissable for the user to violate those conditions. (Committee Fatwa no: 18453 - Sheikh Muhammad bin Saalih Al-`Uthaymeen)
Please put brother Shahid on moderated status and check his articles before transmitting them to your members, inshaa`Allaah. Protect yourselves from association to "literary theft", inshaa`Allaah.

Assalaamu `Alaykum wa Rahmatullaahi wa Barakaatuhu
Dear Brother Shahid,
I pray you are well and in strength of eemaan by the grace of Allaah Subhaanahu wa Ta`aala.
I receive your articles almost daily via several Islamic groups and have found them very informative and beneficial, masha`Allaah.
I am writing with reference to these articles which some brothers and sisters noted that you more often than not, failed to provide the source/name(s) of the respective authours or the websites. So I did a check on most of the articles the brothers and sisters mentioned. I have attached below a list of the articles you posted and have taken the liberty of including the original sources/authours and links.
With regards to your statement at the end of the various articles you posted i.e. <<< "Compiled from various sources." >>> perhaps you may not be aware that if someone uses or borrows another person's direct words/quotations or ideas, that someone (the borrower) is obliged to give the authour credit as the source. When someone deletes the name of the authour from his/her original article(s) and tries to seemingly pass it off as their own, they have committed plagiarism. Even if the borrower really holds these ideas, such use of another person's work (per verbatim) is still considered plagiarism.
What is Plagiarism?
From an Islamic perspective:
" .... trade names, company names, trademarks, writings and inventions are all the copyright of their owners or authors, which in modern practice have acquired monetary value. These rights are respected by sharee'ah and it is not permissible to transgress against them. Copyright of authors and inventors is protected in Islam." http://www.islam-qa.com/index.php?ref=38847&ln=eng
From a Western perspective:
Plagiarism according to Webster's New Collegiate Dictionary means to steal and pass off (the ideas or words of another) as one's own work - i.e. to commit literary theft.
Plagiarism is a legal term referring to the use of someone's ideas, information, language, or writing, when done without proper acknowledgment of the original source." Source: http://www.onelook.com/?w=Plagiarism&ls=a)
From the website: http://www.georgetown.edu/honor/plagiarism.html - quote: "By not attributing the credit to the writer or the website tantamounts to plagiarism. Plagiarism is defined as "the act of passing off as one's own the ideas or writings of another." - unquote.
In the Appendix to the Honour Council pamphlet called "Acknowledging the Work of Others" (which is used by permission of Cornell University), three simple conventions are presented for when you must provide a reference: - quote:
- If you use someone else's ideas, you should cite the name of the author/source.
- If the way in which you are using the source is unclear, make it clear.
- If you received specific help from someone in writing the paper, acknowledge it." - unquote.
- quote: "The World Wide Web has become a more popular source of information for student papers, and many questions have arisen about how to avoid plagiarizing these sources. In most cases, the same rules apply as to a printed source: when a writer must refer to ideas or quote from a WWW site, she must cite that source.
If a writer wants to use visual information from a WWW site, many of the same rules apply. Copying visual information or graphics from a WWW site (or from a printed source) is very similar to quoting information, and the source of the visual information or graphic must be cited. These rules also apply to other uses of textual or visual information from WWW sites; for example, if a student is constructing a web page as a class project, and copies graphics or visual information from other sites, she must also provide information about the source of this information. In this case, it might be a good idea to obtain permission from the WWW site's owner before using the graphics." - unquote.
In closing brother Shahid, I want you to know that you are super good at selecting da`wah material which has benefited many people! So do keep up your da`wah endeavours and inshaa`Allaah from now on, I pray that all of us will endeavour our utmost to do what pleases Allaah Subhaanahu wa Ta`aala by being correct, truthful, sincere and honourable in our intentions, actions and deeds.
Our Prophet Sall Allaahu`alayhi wa sallam said: "Allaah and the angels, and even the ant in its nest and the whale in the sea will pray for the one who teaches people good things." (Reported by al-Tabaraani from Abu Umaamah; see Saheeh al-Jaami', 1838).
Aameen.
Wa aakhir da`waani A`nilhamdulilaahi Rabbil A`lameen.
